Bicyclist Killed On A1A In Fort Lauderdale

A man was struck and killed by a car on A1A in Fort Lauderdale, according to a police department news release.

Daniel Colotte, 59, was riding his bicycle north at the 1100 block of A1A when he was struck by a white Mercedes Benz that was also driving northbound on State Road A1A.

Colotte was taken to Broward General Medical Center where he was pronounced dead.

O’Donnell is being investigated for driving while under the influence; charges are pending.

There is a bike lane where the accident occurred, but it’s a bit narrower at that part of A1A and tends to be more dangerous at night.

What happens if No-Fault expires on October 1

It seems most likely that come October 1st, Florida's No-Fault law will expire. What will happen then? Well first of all, drivers will not be required to carry Personal Injury Protection insurance. People will probably wish to up their uninsured motorist coverage at that point and possibly health insurance as well, because Florida still does not have a law requiring people to carry insurance to cover someone else they may harm in an accident of their doing. Then you have to assume a great number of people will do none of the above and just cut their insurance completely. Those people will still get injured and still seek medical treatment but now without insurance coverage or ability to pay. So private doctors won't treat them as no one can be expected to work for free as a regular job. Who then is left treating injured people with no ability to pay? County hospitals... They will bear the brunt of the burden, adding to their already increasing number of fiscally unsound and uninsured patients. In the end, doctors get hurt, public hospitals get hurt and the average citizen who get injured in an accident will be affected. More and more, it's looking like this is how this situation is looking like it going to unfold.

For more information on this subject matter, please refer to the section on Car and Motorcycle Accidents.

Originally posted at InjuryBoard by Evan Rosen

Personal Injury Case Settles

Our client was involved in an accident when he was broadsided coming through a 4-way stop and suffered substantial injuries which required him to undergo surgery to his lumbar spine and cervical spine. The defendant driver was saying that she was not negligent in driving her vehicle and hence her insurance carrier was denying liability on the claim. Thereafter, depositions were taken of an independent witness and of our client and his wife that clearly showed that the defendant was at fault.

The Defendant's deposition was going to be used to impeach her on the witness stand because she said that our client did things at the scene of the accident such as bang the top of his vehicle and yell obscenities and kick his car further into her car. The insurance company was alleging that all the damage that occurred to our client's car came from his own actions in banging and kicking the car. However, we were successful in finding an independent witness who proved that the Defendant was not telling the truth and on the eve of trial, we were successful in obtaining a substantial settlement on the case.

Originally posted at InjuryBoard by Evan Rosen

Two people were killed Sunday night in an airport shuttle accident involving two shuttles at the Fort Lauderdale airport.
New Year's Day Crash Leaves Three Dead

Around 2 am on New Year's Day, a three car accident left three people dead and eight injured. The accident happened at Broward Boulevard and the southbound exit ramp of I-95.

"We're trying to piece it together," Fort Lauderdale Police Detective Katherine Collins said of the crash at Broward Boulevard and the southbound Interstate 95 exit ramp. "Speed and alcohol are definitely going to be considered, but that's not something we're going to know in the next few days. There was a lot of damage."

There were two cars turning left from the exit ramp onto Broward Boulevard, a Mercury Sable and a Suzuki Aerio. A Chevrolet Impala ran a red light according to witnesses and ran into the driver's side of the Sable. The Sable then spun around and hit the Aerio. The driver and passenger of the Sable were killed instantly. The driver of the Impala, Kyle McKay age 21, died later at the hospital of his injuries.

Originally posted at InjuryBoard by Shannon Weidemann

What to do if you have been involved in accident

If you've been involved in a motor vehicle accident and are injured, the first thing to do is to take care of your injuries and call for help.

As soon as you can, here are 10 important steps to take.

1. Immediately notify the police and call for an ambulance if anyone is injured
Often the 911 operators will call an ambulance for you.

2. Make notes about what happened, gather contact information from othe people at the scene, ask others what they saw and write it down, and take photos if possible.

3. Don't admit to any fault
Don't discuss things at all with anyone beyond obtaining their contact information. Especially don't agree that you were to blame, or volunteer any concessions.

4. Don't accept any money

5. Cooperate with police, medical personnel and insurance people.

6. Obtain the names and badge numbers of any emergency personnel.

7. Have the insurance company inspect damage before any repairs are started

8. If you think that drugs or alcohol were part of it, insist on breath tests.

9. Get copies of any police reports. If you hire a lawyer, he or she will do this for you.

10. Hire a good personal injury attorney
Don't hire the first one you come across. Ask around, then set up interviews with the ones that seemed best to you.
· Have questions ready.
· If the answers are not clear, ask more questions until you understand clearly.
· If the attorney doesn't seem to have time to answer you clearly, move on
· Choose an attorney who has plenty of experience with the type of accident you've been involved in.

Originally posted at InjuryBoard by Evan Rosen
